This website is operated by D.N.A. Inc. (DAKOYU North America Inc.), doing business as D.N.A. Outdoor™. Throughout this document, "we", "us", and "our" refer to D.N.A. Inc. Our store is powered by Shopify Inc., which provides the e-commerce platform enabling us to sell our products and services. Any purchases made through our store are made directly with D.N.A. Inc. — Shopify is not responsible for any aspect of those transactions.

By visiting, browsing, or purchasing from www.dakoyu.com, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use our Services.

Section 1 — Age Requirements & Legal Compliance

By using our Services, you represent that you are at least the age of majority in your province, state, or country of residence. You also consent to allowing minor dependents to use the Services on devices you own or manage.

Because our products include knives, blades, saws, shears, and other sharp or mechanically-loaded everyday carry (EDC) tools, you expressly agree that it is your sole responsibility to comply with all local, provincial, state, federal, and international laws regarding the legal ownership, possession, import, transport, carry, and use of these products. D.N.A. Inc. is not responsible for your compliance with applicable laws in your jurisdiction. You may not use our products for any illegal or unauthorized purpose.

Section 2 — Account & Access

You may be asked to provide an email address, billing, payment, and shipping information to use our Services. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 3 — Products & Product Representations

We have made every effort to accurately represent our products. However, colors and product appearance may differ from what appears on your screen due to device settings and display configurations. We do not warrant that product appearance or quality will meet your expectations or exactly match what is depicted on our site.

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product and to limit quantities sold to any person, geographic region, or jurisdiction.

Section 4 — Orders

Placing an order constitutes an offer to purchase. D.N.A. Inc. reserves the right to accept or decline any order at its sole discretion. Your order is not accepted until we confirm acceptance and process payment. Please review your order carefully before submitting — we may be unable to accommodate cancellations after an order is accepted. If we decline, modify, or cancel an order, we will attempt to notify you via the contact information provided at checkout.

All purchases are subject to our Return & Refund Policy. You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

Section 5 — Prices & Billing

Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as confirmed in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, customs, or import charges.

You agree to provide current, complete, and accurate payment information. You represent and warrant that: (i) your payment information is true, correct, and complete; (ii) you are authorized to use the payment method provided; (iii) charges will be honored by your financial institution; and (iv) you will pay all charges including shipping and applicable taxes.

Section 6 — Shipping, Delivery & Risk of Loss

All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you.

Section 7 — Products, Warranties & DIY Modifications

Manufacturer's Limited Warranty — Tiered Coverage:

5-Year Limited Warranty: Applies to the primary chassis, core structural materials, and internal craftsmanship of designated premium D.N.A. Outdoor™ multi-tools. Covers manufacturing defects under standard operational use.
1-Year Limited Warranty: Applies to standalone accessories such as sheaths and auxiliary gear. Does not apply to consumables including replacement wire-cutters, driver bits, sharpeners, files, ferrocerium rods, or similar items.

Warranty Exclusions: Neither warranty covers standard wear and tear, cosmetic scratching, rust, corrosion, accidents, misuse, or damage from over-torquing.

How to Submit a Warranty Claim: Contact support@dakoyu.com with: (1) original order number or proof of purchase; (2) clear photographic or video evidence of the defect; and (3) a description of how the failure occurred. We reserve the right to require physical return of the item for inspection before authorizing repair or replacement.

DIY Modifications:

Permitted: Standard user maintenance and official modular part swaps (designated blades, clips, or accessories purchased directly from us) will not automatically void your warranty.
Prohibited: Structural grinding, drilling, heating, welding, altering safety locks, or forcing unapproved third-party components into the tool is strictly prohibited. Damage caused by prohibited modifications completely voids both warranty tiers.
Return Condition: Products must be in original factory configuration or authorized D.N.A. Outdoor™ part configuration to be eligible for return. Loose, partially disassembled, or permanently altered tools cannot be accepted for return.

Section 8 — International Shipping, Customs & Regulatory Compliance

We ship to various global jurisdictions. By purchasing from D.N.A. Outdoor™, you acknowledge and agree that:

Import Duties & Taxes (non-US): All international shipments outside the United States may be subject to import duties, customs fees, and local taxes assessed by your destination country. You are solely responsible for all such charges.
US Orders — DDP: Orders shipped to the United States include a mandatory US Government Import Tariff Fee collected at checkout. See our Shipping Policy for full details.
Customs Seizures: Different jurisdictions have varying legal classifications for pocket knives, multi-tools, locking blades, and assisted-opening mechanisms. D.N.A. Inc. is not responsible for packages confiscated, destroyed, or delayed by customs authorities. No refunds will be issued for items seized by foreign customs.
Buyer Compliance: It is your sole responsibility to ensure that the products you order are legal to import, own, carry, and use in your jurisdiction.

Section 9 — Intellectual Property

All content on our Services — including trademarks, brand names, text, images, graphics, video, audio, product designs, and arrangements — is owned by D.N.A. Inc., its affiliates, or licensors and is protected by Canadian, US, and international intellectual property laws.

You may use our Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from our Services without prior written consent. D.N.A. Outdoor™, D.N.A. Inc., DAKOYU™, and associated logos and product names are trademarks of D.N.A. Inc. Unauthorized use is prohibited. All rights not expressly granted are reserved.

Section 10 — Third-Party Links & Optional Tools

Our Services may contain links to third-party websites or provide access to third-party tools. We are not responsible for the content, accuracy, or practices of any third-party sites or tools. Access to third-party content is at your own risk. We provide optional third-party tools "as is" without any warranties or endorsement and bear no liability for their use.

Section 11 — Relationship with Shopify

D.N.A. Outdoor™ is powered by Shopify, which enables us to provide our Services. However, all sales and purchases are made directly with D.N.A. Inc. Shopify is not responsible for any aspect of transactions between you and D.N.A. Inc., including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims arising from your transactions with D.N.A. Inc.

Section 12 — Privacy

All personal information collected through our Services is subject to our Privacy Policy. By using our Services, you acknowledge that information may be transmitted to and shared with Shopify and third-party service providers in order to fulfill your orders and operate our Services.

Section 13 — Feedback & User Submissions

By submitting ideas, suggestions, reviews, or other feedback to us, you grant D.N.A. Inc. a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute such content for any purpose, including commercial use. We are under no obligation to maintain feedback in confidence, compensate you for it, or respond to it.

Section 14 — Accuracy, Errors & Omissions

We reserve the right to correct any errors, inaccuracies, or omissions and to update information or cancel orders at any time without prior notice, including after an order has been submitted.

Section 15 — Prohibited Uses

You may not use our Services: (a) for any unlawful purpose; (b) to violate any laws or regulations; (c) to infringe intellectual property rights; (d) to harass, harm, or defame any person; (e) to transmit false or misleading information; (f) to send spam or unsolicited communications; (g) to impersonate any person or entity; (h) to upload viruses or malicious code; (i) to scrape, spider, or harvest data; or (j) to interfere with the security or operation of our Services. We reserve the right to terminate access for any violation, without notice.

Section 16 — Disclaimer of Warranties & Product Safety

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, OR NON-INFRINGEMENT.

Product Safety & Injury Liability: D.N.A. Outdoor™ multi-tools contain sharp, mechanical, and potentially dangerous components including blades, saws, wire cutters, files, and tension-loaded mechanisms. These tools must be handled with extreme care and used exclusively for their intended purposes.

UNDER NO CIRCUMSTANCES SHALL D.N.A. INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY PHYSICAL INJURY, BODILY HARM, LACERATION, OR ACCIDENTAL DEATH RESULTING FROM THE USE, MISUSE, STORAGE, TRANSPORT, OR ASSEMBLY OF OUR PRODUCTS. This exclusion applies with absolute strictness to any tool that has undergone consumer DIY modifications beyond permitted maintenance.

Section 17 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, D.N.A. INC., ITS AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE ITEM IN QUESTION. Some jurisdictions do not allow certain liability exclusions — in such cases our liability shall be limited to the maximum extent permitted by applicable law.

Section 18 — Indemnification

You agree to indemnify, defend, and hold harmless D.N.A. Inc., Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, and licensors from any claims, losses, damages, and liabilities, including reasonable attorneys' fees, arising out of: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your access to and use of our Services or products.

Section 19 — Termination

We may terminate your access to our Services at any time without notice at our sole discretion. All provisions that by their nature should survive termination shall survive, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

Section 20 — Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

Section 21 — Waiver & Entire Agreement

Our failure to enforce any right or provision does not constitute a waiver. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and D.N.A. Inc. and supersede all prior agreements. Any ambiguities shall not be construed against the drafting party.

Section 22 — Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. D.N.A. Inc. may transfer or assign these Terms without your consent.

Section 23 — Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved exclusively in the competent courts of British Columbia, Canada, unless otherwise mandated by applicable consumer protection laws in your jurisdiction.

Section 24 — Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated in accordance with applicable law. Continued use of our Services following any changes constitutes acceptance of the updated Terms. The current version is always available at www.dakoyu.com.
